Terms of Service

These terms govern any website build, Care Plan, or related service (“Services”) provided by FundaHosting, trading as funda.africa (“funda”, “we”, “us”), to a client (“you”). By engaging funda for a build or Care Plan, you agree to these terms.

1. Proposals and scope

Every project starts with an alignment call and a written proposal setting out scope, price and timeline. Work begins once you accept the proposal. Anything outside the agreed scope — extra pages, custom features, additional revisions beyond what’s included — is quoted separately before we start it.

2. Payment

Website builds are once-off fees, payable as set out in your proposal (typically a deposit to start, balance on delivery).
Care Plans are billed monthly in advance, or annually in advance at a discount (2 months free) — see our Care Plan Terms for full billing detail.
Late payment may result in a service pause until the account is brought up to date; we’ll always give notice first.

3. Intellectual property

Once your build is paid in full, the website design and content we created for you are yours to use for your business. Any general-purpose code, components or theme infrastructure funda uses across multiple clients remains funda’s, licensed to you for use on your site.

4. You own your domain and your content

Your domain is, and always will be, registered in your name — you are the registrant, funda is only the administrative/technical contact where needed to manage it on your behalf. Your website content, images and copy you provide remain yours. If you ever leave funda, your domain and your content go with you.

5. Warranties and liability

We build and maintain your site with reasonable skill and care, using established, secure hosting infrastructure. We do not guarantee uninterrupted availability, and we are not liable for indirect or consequential losses (such as lost business or lost data caused by factors outside our reasonable control, e.g. third-party outages). Our total liability for any claim is limited to the fees you’ve paid us for the Service in question over the preceding 3 months.

6. Termination

You may end a website-build engagement at any stage before delivery by paying for work completed to date. Care Plan termination, notice periods and what happens to your site on cancellation are covered in our Care Plan Terms.

7. Confidentiality and data protection

Where we process personal information on your behalf — for example, data collected through your website — we do so under the terms of our Privacy Policy and a written operator agreement, in line with South Africa’s Protection of Personal Information Act (POPIA).

8. Governing law

These terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.

9. Changes to these terms

We may update these terms from time to time; the “last updated” date above reflects the most recent version. Material changes affecting active clients will be communicated directly.
